UPDATE: Federal judge rules for temporary return of dog to disabled veteran
A federal judge in Sioux City ordered the temporary return of a service dog to his disabled owner. In November, Jim Sak, a retired Chicago police officer, moved to Aurelia, Iowa with his pit bull mix, to help his ailing mother-in-law.
The issue is there's a ban on pit bulls within city limits. The dog, "Snickers", was taken away, and Sak sued the city of Aurelia to get him back.
In federal court Wednesday morning, a judge granted a preliminary injunction meaning Sak will get his dog back until the lawsuit is over.
The court will ultimately choose whether the dog can remain in the city permanently.
"The immediate remedy is getting Snickers back in the home, but like we said, that's a temporary fix. What we need is permanent order from the court allowing Snickers to remain within the Aurelia city limits. Then there's also a variety of requests under the complaint that was filed as well, so a regular lawsuit will proceed," said Sak's attorney Michele Warnock.
The next court date for Sak has not been set.
